Crime is Corruption: Official Position Used for Personal Gain



Setting the Scene: Sentencing for Federal corruption cases (using official position for personal gain) depends in part on the value of the item or service that was received by the corrupt individual. 

The Crime Cited at Cornell Law: Prosecution of Federal officials for corruption which is probably Kushner’s case – simply stated:


Background and Penalty: If the value of the items were equivalent to grand theft or grand larceny, this can be prosecuted as a separate charge on top of the federal corruption charges. Likewise, bribery, graft, and conspiracy charges are frequently included. 



My 2 cents: This on the surface seems to be am open and shut case against Kushner. Also, I’m sure that S/C Robert Mueller is on top of and all over this as well. We shall see.

I note: For the amount Kushner received ($500 million) – I would say 16 years of jail time would fit nicely – or maybe more depending on trial outcome (that assumes no Trump pardon).

I heard that Kushner said to his father-in-law, the President, as they passed each other in the tight and busy hallway and after Kushner heard about this event: “Pardon me.” (Smile)
