His pose shows
his arrogance, defiance,
and
ignorance
Trump on two time-tested issues:
Re: Flag burning is protected free speech:
Cite Johnson vs. Texas
(1989 USSC ruling).
FYI: In that 5-to-4
decision, the high Court held that burning of a flag was protected expression
under the First Amendment.
Trump tweeted: “Nobody should be allowed to burn the
American flag - if they do, there must be consequences - perhaps loss of
citizenship or year in jail!” — Donald J. Trump @realDonaldTrump November 29, 2016
FYI: Government cannot
take away any American’s citizenship (unless
they are naturalized and lied during the process) but not from a U.S. born
citizen.
Cite: Afroyim v. Rusk (1967).
In that 5-to-4 decision the high Court held that Congress has no general power to revoke American citizenship without
consent.
So,
would the high court reconsider now under Trump? According
to the New York Times, the Supreme Court is unlikely to reconsider the
issue of flag burning anytime soon.
FYI: Chief Justice
John Roberts and Justice Brett Kavanaugh both have suggested that they support
the court's 1989 decision on the matter.
My 2 cents: Why does Trump not know
the law and worse, why aren’t those around him telling him? On, yeah – don’t
want to piss him off.
Stay tuned – more Trump ignorant insanity
surely will follow because he follows this view:
