Manhattan DA vs. Trump: Is the DA Pursuing Trump on Criminal Charges or Not

Is Trump's arrogance prevailing over justice

The New York Manhattan DA, Alvin Bragg, looks like he will drop the criminal investigation of Trump and his organization based on this story from Rolling Stone with this headline – (key parts follow for clarity and impact of the seriousness of this story):

“New York Prosecutor Says He Resigned over Failure to Charge Trump, Who is Guilty of Multiple Felony Violations”

“The team that has been investigating Mr. Trump harbors no doubt about whether he committed crimes — he did,” wrote Prosecutor Mark Pomeranz in February to the Manhattan DA

Former Manhattan DA Cyrus Vance in 2018 launched an investigation into Trump’s financial practices, specifically whether he lied about the value of his assets to help him obtain loans.

Vance’s office had already charged Trump Organization executive Allen Weisselberg, as well as the company itself, with a bevy of financial crimes, including federal tax fraud, falsifying business records, grand larceny, and scheme conspiracy.

When Alvin Bragg took over for Vance earlier this year, he decided to not pursue charges prompting the resignation of Mark Pomeranz and Carey Dunne, two prosecutors who had been working on the case.

The New York Times on Wednesday published Pomeranz’s resignation letter, in which he states a belief that Trump is “guilty of numerous felony violations.”

Pomeranz’s letter to Bragg says in key part: His financial statements were false, and he has a long history of fabricating information relating to his personal finances and lying about his assets to banks, the national media, counterparties, and many others, including the American people. The team that has been investigating Mr. Trump harbors no doubt about whether he committed crimes — he didI believe that your decision not to prosecute Donald Trump now, and on the existing record, is misguided and completely contrary to the public interest, I therefore cannot continue in my current position.”

Important part of this:

Pomeranz may have been convinced the office had enough evidence to nail Trump, but Bragg’s concern about proving the former president had first-hand knowledge of fraud is a legitimate one.

Daniel Goldman, the lead counsel for the effort to impeach Trump, and who briefly entered the race for New York AG last year noted that it would have been in Bragg’s political interest to indict the former president saying in a tweet: “There is a BIG difference between *knowing* somebody committed crimes and *proving* those crimes in court. I am certain that Bragg’s decision was solely about the evidence — and nothing else — as every case should be.”

My 2 Cents: DA Alvin Bragg is the boss and he makes the decisions, even like this one – I don’t know his thinking process, but he is the boss. 

However, he also has said the case continues down the path but not the same path Vance’s team was pursuing, or so it seems. Thus, we will have to wait and see the outcome from his approach.

B/L: Just as Pomeranz, former, and present prosecutors have stated about this case and others:No one is above the law.” I think we all can agree on that time-tested judicial bedrock premise, right?

So, we watch the way DA Bragg warrants and let justice take its course. Dropping it now only would embolden Trump and give him boat load of 2024 rally talking points and further to what end – who knows. 

Most certainly we would see more Trump attacks on our entire democratic and judicial systems and way of life itself. That is a proven historical fact with Donald J. Trump and it cannot be disputed (even though this “new” Trump owned and operated GOP does so in his favor).
