Trump’s Latest Financial Ploy: Touts Disclaimer as Cover for His Financial Crimes

The #1 crime family ever in the U.S. and possibly ever in the entire history of the world is that of Donald J. Trump (and his father before him) and their combined families.

Cite this story from Business Insider and their headline as astonishing and this shorter version from the Washington Examiner – same subject just a shorter read:

“Donald Trump says a simple disclaimer gives him immunity from fraud. Could he have a point?”

Trump blasted a civil fraud lawsuit against him and his three adult children unveiled by New York’s AG Letitia James during his recent interview with Fox’s Sean Hannity. 

Trump called the lawsuitA continuation of a witch hunt that began when I came down the escalator at Trump tower” (in reference to his 2015 speech announcing his intention to run for president).

Trump also accused James of campaigning on going after him and said: “She is trying to defend banks that got paid off,then adding:Well, she campaigned on it four years ago. It was a vicious campaign, and she just talked about Trump and 'we're going to indict him, we're going to get him.' She knew nothing about me. I never heard of her. I was under the impression she wanted to settle the case and didn't or wasn’t going to file a lawsuit after I sat for a deposition related to the case last month.”

The lawsuit alleges that the Trump Organization:Manipulated asset valuations to deceive banks and the people of the great state of New York.” James is seeking for Trump and his company to pay a minimum of $250 million for allegedly engaging in fraudulent business practices.

Trump said of the on-going investigation:They've demeaned me for years with this stuff, and now they find out I have very little debt, very, very little, a lot of cash, we have a great company, and we have among the best assets anywhere in the world. There's something wrong with them. I really believe they hate our country.”

Trump claimed during the interview, which took place at his Mar-a-Lago, that all parties that his company obtained loans from were paid back and that his company includes a lengthy disclaimer with all financial disclosures it provides to banks, adding in part:It goes on for like a page and a half. It's a big disclaimer. It's a very powerful disclaimer. What we say is, here's a financial statement but be careful, it may not be accurate, and it may be way off.” (He said, describing the disclaimer).

James's lawsuit also calls for Trump, Donald Trump Jr., Ivanka Trump, and Eric Trump: “To be barred from serving as an officer or director in any corporation or similar entity in New York State, and for the former president and his company to be barred from entering into any New York State commercial real estate acquisition, or from applying for loans in New York for the next five years.”

James has been conducting an investigation into the Trump Organization since 2019, when former Trump lawyer Michael Cohen testified before Congress that the Trump Organization manipulated asset valuations for tax and business benefit.

My 2 Cents: Let’s face it, Trump is a smart, skilled, and clever (at least he thinks so) businessman who takes pride in not paying his taxes even having said in the past: “I consider that smart to not pay taxes [sic].” 

In essence what Trump is saying about the disclaimer and its cover for him is one or all three of these analogies:

1. “Lenders beware and shame on you for not catching my lies and exaggerations about my assets.”

2. “The FBI couldn’t catch me after I robbed the bank, and now the money that I took is safe with me – so hands off.”

3. “A criminal broke into a home to steal jewelry, He didn’t find it and when he leaves the cops grab him. He says: “Hey I didn’t steal anything, you can’t arrest me.” Then Cops said: True, but breaking and entering is a crime. Now, put your hands behind your back.”

Trump has never been held accountable for much of his wrongdoings. He cheats or lies, or pays his way out, and then he moves on to the next con or scheme or flim-flam. That is he M.O. and it has been his whole adult life. But, now the walls truly are closing in on him and rightly so. Stay tuned.
